\u00ab\u00a0L\u00e9gislation Europ\u00e9enne : Revente de Logiciels\u00a0\u00bb<\/h2>\n

Eu \u00e9gard au principe de base des logiciels, lorsque la distribution de logiciels informatiques s\u2019effectue par vente, les ventes de licences logicielles secondaires sont r\u00e9gies par les dispositions de l\u2019article 4,paragraphe 2 de La Directive Europ\u00e9enne sur les Logiciels 2009\/24\/CE (Fran\u00e7ais)<\/a>qui stipule ce qui suit : \u00ab La premi\u00e8re vente d\u2019une copie d\u2019un programme d\u2019ordinateur dans la Communaut\u00e9 par le titulaire du droit ou avec son consentement \u00e9puise le droit de distribution de cette copie dans la Communaut\u00e9, \u00e0 l\u2019exception du droit de contr\u00f4ler des locations ult\u00e9rieures du programme d\u2019ordinateur ou d\u2019une copie de celui-ci \u00bb.<\/p>\n

Le 3 juillet 2012, la Cour de justice de l\u2019Union europ\u00e9enne (CJUE) s\u2019est prononc\u00e9e contre Oracle<\/a> dans une affaire qui a r\u00e9affirm\u00e9 la revente de logiciels secondaires en Europe. La CJUE a statu\u00e9 que le \u00ab principe d\u2019\u00e9puisement \u00bb s\u2019applique \u00e9galement aux logiciels mat\u00e9riels\/num\u00e9riques, ce qui comprend les accords de licence en volume vendus par d\u2019autres fournisseurs de logiciels tels que Microsoft. Mod\u00e8les Commerciaux Ill\u00e9gaux :<\/h2>\n

Des mod\u00e8les commerciaux ill\u00e9gaux ont \u00e9merg\u00e9 au sein d\u2019un secteur des licences logicielles secondaires en pleine croissance.<\/p>\n

Sachez que sont d\u00e9lib\u00e9r\u00e9ment revendus de cette mani\u00e8re des logiciels qui \u00ab ne conviennent pas \u00e0 l\u2019usage pr\u00e9vu \u00bb et qui ne passeraient pas avec succ\u00e8s un audit de fournisseur de logiciel. \u00c0 titre d\u2019exemple, certains fournisseurs font de la publicit\u00e9 en pr\u00e9sentant une \u00ab Attestation notariale \u00bb en guise d\u2019\u00ab assurance \u00bb l\u00e9gale pour le client, alors que, dans les faits, une telle attestation peut \u00eatre utilis\u00e9e (et cela a d\u00e9j\u00e0 \u00e9t\u00e9 le cas) pour dissimuler une source potentiellement ill\u00e9gale. D\u2019autres fournisseurs malveillants de logiciels revendent ill\u00e9galement des packs Microsoft Partner ou des t\u00e9l\u00e9chargements\/cl\u00e9s MSDN \u00e0 des prix extr\u00eamement bas (m\u00eame par rapport aux niveaux de prix du march\u00e9 des logiciels secondaires). Il existe \u00e9galement des fournisseurs de logiciels secondaires qui revendent des \u00ab certificats logiciels \u00bb d\u2019entreprises \u00e9labor\u00e9s par leurs soins et qui fournissent des factures sur lesquelles figurent des descriptions de produits mais pas les informations relatives au num\u00e9ro unique de l\u2019accord de licence Microsoft du client original de Microsoft.<\/p>\n

Dans ces cas, les clients de logiciels d\u2019occasion peuvent se retrouver \u00e0 acheter involontairement du beau papier \u00e0 en-t\u00eate ou de beaux certificats sur papier glac\u00e9, mais aucune licence logicielle l\u00e9gitime. Si les gains financiers \u00e0 court terme peuvent sembler attrayants \u00e0 premi\u00e8re vue, ils s\u2019\u00e9vaporent au moment de tout audit lorsque les clients sont menac\u00e9s de poursuites judiciaires pour cause de non-conformit\u00e9 par l\u2019\u00e9diteur de logiciels.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Discount-Licensing est certifi\u00e9 ISO 9001 : 2015<\/a> (EU et RU), fournissant des produits logiciels et des services qui r\u00e9pondent aux exigences r\u00e9glementaires\/statutaires applicables ainsi qu’aux exigences des clients conform\u00e9ment aux crit\u00e8res de l’Organisation internationale de normalisation. Afin de se conformer \u00e0 La Directive Europ\u00e9enne sur les Logiciels 2009\/24\/CE<\/a> et \u00e0 l\u2019arr\u00eat de la Cour de Justice de l\u2019Union Europ\u00e9enne (CJUE) de juillet 2012<\/a>, tout fournisseur de logiciels secondaires l\u00e9gitime doit \u00eatre en mesure de satisfaire aux exigences suivantes pour chaque transaction :<\/p>\n

1. Le logiciel a d\u2019abord \u00e9t\u00e9 \u00ab mis en service \u00bb au sein de l\u2019Europe (\u00ab pays d\u2019utilisation d\u2019origine du logiciel \u00bb) ;<\/p>\n

2. Les num\u00e9ros uniques du contrat de licence (CL) \/ du num\u00e9ro de r\u00e9f\u00e9rence du produit du client Microsoft original, lesquels identifient la soci\u00e9t\u00e9 qui a initialement achet\u00e9 le logiciel ainsi que ce qui avait \u00e9t\u00e9 achet\u00e9 ;<\/p>\n

3. La confirmation du fait que le logiciel d\u2019occasion a \u00e9t\u00e9 c\u00e9d\u00e9 et d\u00e9sinstall\u00e9 du ou des serveur(s) du client original de Microsoft ;<\/p>\n
