\u201cDerecho Europeo: Reventa de Software\u201d:<\/h2>\n

En relaci\u00f3n con el principio b\u00e1sico del software, seg\u00fan el cual la distribuci\u00f3n de programas inform\u00e1ticos se produce mediante una venta, las ventas de licencias de software de segunda mano est\u00e1n incluidas en la Directiva europea sobre programas de ordenador 2009\/24\/EC (espa\u00f1ol), Art\u00edculo 4(2)<\/a>, que establece: \u00abLa primera venta en la Comunidad de una copia de un programa por el titular de los derechos o con su consentimiento, agotar\u00e1 el derecho de distribuci\u00f3n en la Comunidad de dicha copia, salvo el derecho de controlar el subsiguiente alquiler del programa o de una copia del mismo\u00bb.<\/p>\n

El 3 de julio de 2012, el Tribunal de Justicia de la Uni\u00f3n Europea (TJUE) fall\u00f3 en contra de Oracle<\/a> en un caso que reafirm\u00f3 la reventa de software de segunda mano en Europa. El TJUE dictamin\u00f3 que el \u00abprincipio del agotamiento\u00bb tambi\u00e9n se aplica a software intangible\/digital, lo que incluye contratos de licencias por volumen vendidos por otros vendedores de software como Microsoft. Modelos de Negocio Ilegales:<\/h2>\n

Dentro del creciente sector de las licencias de software de segunda mano han surgido modelos de negocio ilegales.<\/p>\n

Tenga en cuenta que se est\u00e1 revendiendo deliberadamente software que no es \u00abadecuado para su finalidad\u00bb y no aprobar\u00eda una auditor\u00eda de vendedores de software. Por ejemplo, hay proveedores de software de segunda mano que anuncian el uso de una \u00abcertificaci\u00f3n notarial\u00bb como un \u00abseguro\u00bb legal para el cliente pero, en realidad, se podr\u00eda usar (y ya se ha usado) a un notario para ocultar una fuente potencialmente ilegal. Otros proveedores de software deshonestos revenden ilegalmente la descarga\/las claves de Microsoft Partner Pack o MSDN a precios extremadamente bajos (incluso en comparaci\u00f3n con los niveles de precios del mercado de software de segunda mano). Tambi\u00e9n vemos que proveedores de software de segunda mano revenden \u00abcertificados de software\u00bb de empresa dise\u00f1ados por ellos mismos y proporcionan facturas con descripciones de productos sin el n\u00famero \u00fanico del acuerdo de licencia de Microsoft del cliente original de Microsoft.<\/p>\n

En estos casos, puede que los clientes de software de segunda mano est\u00e9n comprando sin saberlo papel membretado sin valor o certificados que no contienen ninguna licencia de software leg\u00edtima. Los beneficios financieros a corto plazo pueden parecer atractivos en su momento, pero se evaporar\u00e1n cuando se realice una auditor\u00eda y haya que enfrentarse a la amenaza del vendedor de software de emprender acciones legales por incumplimiento.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

Informaci\u00f3n Legal – Lista de Verificaci\u00f3n:<\/h2>\n

Discount-Licensing cuenta con la certificaci\u00f3n ISO 9001: 2015<\/a> (Uni\u00f3n Europea y Reino Unido), y ofrece productos y servicios de software que cumplen los requisitos reglamentarios o legales vigentes, as\u00ed como los requisitos del cliente, de conformidad con los criterios de la Organizaci\u00f3n Internacional de Normalizaci\u00f3n. Con el fin de cumplir la Directiva europea sobre programas de ordenador 2009\/24\/EC<\/a> y la sentencia del Tribunal de Justicia de la Uni\u00f3n Europea (TJUE) de julio de 2012<\/a>, un proveedor leg\u00edtimo de software de segunda mano deber\u00eda poder proporcionar lo siguiente en cada transacci\u00f3n:<\/p>\n

3. La confirmaci\u00f3n de que se ha quitado y desinstalado el software del\/de los servidor\/es del cliente original de Microsoft;<\/p>\n
